You can obtain this ship for free by the 2nd anniversary event from the 2nd February to 6th February.

And if you think Captain Eks is going to change ships, then the answer is a big NO! The USS Independence is his home and so it shall remain!
Feel free to get the ship yourself though and use them in RPing, I have no problem with it.
I myself will make it the endship for M'shiva, the (time displaced? mirror-universe?) caitian.
